1. Geltungsbereich
• Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen von Privatkunden und Geschäftskunden, die über das WhatsApp-Bestellformular bei German Bakery Penzkofer erfolgen.
2. Bestellprozess
• Bestellungen erfolgen ausschließlich per WhatsApp über das bereitgestellte Formular.
• Bestellschluss ist 18:00 Uhr am Vortag der gewünschten Lieferung (werktags bzw. an Öffnungstagen).
• Das Produktsortiment sowie geltende Mindestbestellwerte sind auf unserer Speisekarte bzw. Website einsehbar.
• Der Kunde muss im Formular die vollständige Lieferadresse sowie einen geeigneten Ablageort angeben (z. B. Hotelrezeption, Haustür, Terrasse).
3. Lieferung
• Die Lieferung erfolgt ausschließlich werktags zwischen 05:00 und 09:00 Uhr bzw. innerhalb unserer offiziellen Öffnungszeiten.
• Geliefert wird im Umkreis von 20 km um den Geschäftssitz in Vélez-Málaga.
• Es fällt eine Liefergebühr an, die ab einem bestimmten Bestellwert entfällt (Details siehe Website).
• Die Lieferung erfolgt kontaktlos an den angegebenen Ablageort.
• Zum Nachweis wird ein Foto des abgelieferten Produkts erstellt und per WhatsApp gesendet.
4. Zahlung
• Die Zahlung erfolgt ausschließlich vorab über PayPal.
• Dort sind auch Zahlungen per Kreditkarte, RealPay, Visa etc. möglich.
• Erst nach Zahlungseingang gilt die Bestellung als verbindlich.
5. Widerruf und Stornierung
• Da es sich um verderbliche Lebensmittel handelt, ist ein Widerrufsrecht gemäß § 103 des spanischen Verbraucherschutzgesetzes ausgeschlossen.
• Eine Stornierung nach erfolgter Zahlung ist nicht möglich.
6. Reklamationen & Rückerstattung
• Sollte eine Lieferung fehlerhaft oder unvollständig sein, wird der entsprechende Betrag rückerstattet.
• Eine Rückgabe oder ein Umtausch bereits gelieferter Ware ist nicht möglich.
7. Datenschutz
• Kundendaten (Name, Telefonnummer, Adresse, Ablageort) werden ausschließlich zur Abwicklung der Bestellung verwendet.
• Es erfolgt keine Weitergabe an Dritte und keine Nutzung zu Werbezwecken.
• Eine vollständige Datenschutzerklärung ist auf Anfrage erhältlich.
8. Geltendes Recht
• Es gilt ausschließlich spanisches Recht.
• Gerichtsstand ist Vélez-Málaga (Spanien).
9. Hinweise für Geschäftskunden (B2B)
• Die obenstehenden Regelungen gelten entsprechend.
• Geschäftskunden erhalten auf Wunsch eine Rechnung mit NIF-Angabe.

1. Scope of Application
• These Terms and Conditions (T&C) apply to all orders placed by private and business customers via the WhatsApp order form at German Bakery Penzkofer.
2. Order Process
• Orders are placed exclusively via WhatsApp using the provided order form.
• The order deadline is 6:00 p.m. on the day before delivery (on working days or open days).
• The product range and applicable minimum order values are listed on our menu and website.
• Customers must specify the full delivery address and a suitable drop-off location (e.g. hotel reception, front door, terrace) in the form.
3. Delivery
• Deliveries are made exclusively on working days between 5:00 a.m. and 9:00 a.m. or during our official business hours.
• We deliver within a 20 km radius around our business location in Vélez-Málaga.
• A delivery fee applies, which is waived for orders above a certain value (see website for details).
• Delivery is contactless to the location provided by the customer.
• A photo of the delivered goods will be taken and sent via WhatsApp as proof of delivery.
4. Payment
• Payment must be made in advance via PayPal.
• Payment via credit card, RealPay, Visa, etc. is also available through PayPal.
• The order becomes binding only after receipt of payment.
5. Cancellation & Right of Withdrawal
• Since we supply perishable goods, the right of withdrawal is excluded under Article 103 of Spanish consumer law.
• Cancellation after payment is not possible.
6. Complaints & Refunds
• If a delivery is incomplete or incorrect, the corresponding amount will be refunded.
• Returns or exchanges of delivered goods are not possible.
7. Data Protection
• Customer data (name, phone number, address, drop-off location) is used exclusively to process the order.
• No data will be shared with third parties or used for advertising purposes.
• A full privacy policy is available upon request.
8. Applicable Law
• Spanish law exclusively applies.
• Place of jurisdiction is Vélez-Málaga (Spain).
9. Business Customers (B2B)
• The above conditions apply accordingly.
• Invoices including the customer’s NIF can be issued on request.

1. Ámbito de aplicación
• Estas Condiciones Generales (CG) se aplican a todos los pedidos realizados por clientes particulares y comerciales a través del formulario de pedido por WhatsApp de German Bakery Penzkofer.
2. Proceso de pedido
• Los pedidos se realizan exclusivamente por WhatsApp mediante el formulario proporcionado.
• El plazo para realizar pedidos es hasta las 18:00 h del día anterior a la entrega (días laborables o días de apertura).
• La gama de productos y los valores mínimos de pedido aplicables están disponibles en nuestra carta y en la página web.
• El cliente debe indicar la dirección completa de entrega y un lugar seguro para dejar el pedido (por ejemplo, recepción del hotel, puerta de entrada, terraza).
3. Entrega
• Las entregas se realizan exclusivamente en días laborables entre las 05:00 y las 09:00 h o durante el horario comercial oficial.
• Entregamos en un radio de 20 km desde nuestra ubicación en Vélez-Málaga.
• Se aplica una tarifa de entrega, que se elimina para pedidos que superen un determinado importe (ver detalles en la web).
• La entrega es sin contacto en el lugar indicado por el cliente.
• Se toma una foto del pedido entregado y se envía por WhatsApp como prueba.
4. Pago
• El pago debe realizarse por adelantado mediante PayPal.
• También se aceptan pagos con tarjeta de crédito, RealPay, Visa, etc. a través de PayPal.
• El pedido se considera vinculante únicamente tras la recepción del pago.
5. Cancelación y derecho de desistimiento
• Dado que se trata de productos perecederos, el derecho de desistimiento queda excluido conforme al artículo 103 de la ley española de protección al consumidor.
• No se aceptan cancelaciones después del pago.
6. Reclamaciones y reembolsos
• Si una entrega es incompleta o incorrecta, se reembolsará el importe correspondiente.
• No se aceptan devoluciones ni cambios de productos entregados.
7. Protección de datos
• Los datos del cliente (nombre, número de teléfono, dirección, lugar de entrega) se utilizan exclusivamente para procesar el pedido.
• No se comparten datos con terceros ni se utilizan con fines publicitarios.
• La política de privacidad completa está disponible a petición.
8. Legislación aplicable
• Se aplica exclusivamente la legislación española.
• El lugar de jurisdicción es Vélez-Málaga (España).
9. Clientes comerciales (B2B)
• Las condiciones anteriores se aplican en consecuencia.
• Se puede emitir una factura con el NIF del cliente previa solicitud.
