1. Geltungsbereich
Diese AGB gelten für alle Bestellungen von Privat- und Geschäftskunden, die telefonisch oder elektronisch (z. B. per WhatsApp, SMS oder E-Mail) bei German Bakery Penzkofer eingehen.
2. Bestellung
• Bestellungen erfolgen schriftlich über WhatsApp (per Formular oder Freitext).
• Bestellschluss: 18:00 Uhr am Vortag der gewünschten Lieferung.
• Das Sortiment und die Mindestbestellwerte sind auf unserer Speisekarte oder Website einsehbar.
• Bitte gib eine vollständige Lieferadresse und einen geeigneten Ablageort an (z. B. Haustür, Terrasse, Hotelrezeption).
3. Lieferung
• Lieferzeit: Werktags zwischen 05:00 und 09:00 Uhr oder während unserer offiziellen Öffnungszeiten.
• Lieferung im Umkreis von 20 km rund um Vélez-Málaga.
• Es fällt eine Liefergebühr an, die ab einem bestimmten Bestellwert entfällt (Details auf unserer Website).
• Die Lieferung erfolgt kontaktlos oder persönlich – je nach Wunsch des Kunden.
• Ein Foto der Lieferung dient als Zustellnachweis und wird per WhatsApp gesendet.
4. Zahlung
• Zahlung vorab digital (z. B. PayPal, Kreditkarte) oder bar bei Lieferung.
• Die Bestellung ist nur gültig, wenn die Zahlung erfolgt ist oder Barzahlung vereinbart wurde.
5. Stornierung & Widerruf
• Da es sich um verderbliche Lebensmittel handelt, ist ein Widerrufsrecht laut § 103 des spanischen Verbraucherschutzgesetzes ausgeschlossen.
• Eine Stornierung nach erfolgter Zahlung ist nicht möglich.
6. Reklamationen
Wir legen größten Wert auf Qualität.
• Bitte prüfe deine Lieferung direkt bei Erhalt auf Vollständigkeit und Mängel.
• Sollte es Beanstandungen geben, bitte sofort melden, damit wir gemeinsam eine Lösung finden.
• Spätere Reklamationen können bei frischen Produkten leider nur eingeschränkt berücksichtigt werden.
7. Datenschutz
• Deine Daten (Name, Telefonnummer, Adresse, Ablageort) werden ausschließlich zur Abwicklung der Bestellung verwendet.
• Keine Weitergabe an Dritte – keine Werbung.
• Eine vollständige Datenschutzerklärung ist auf Anfrage erhältlich.
8. Rechtliches
• Es gilt ausschließlich spanisches Recht.
• Gerichtsstand ist Vélez-Málaga (Spanien).
9. Geschäftskunden (B2B)
• Für Geschäftskunden gelten die gleichen Bedingungen.
• Auf Wunsch stellen wir eine Rechnung mit NIF-Angabe aus.

1. Scope
These Terms and Conditions apply to all orders placed by private or business customers via telephone or electronic means (e.g. WhatsApp, SMS, or email).
2. Orders
• Orders must be placed in writing via WhatsApp (form or free text).
• Order deadline: 6:00 p.m. the day before delivery.
• Our product range and minimum order values are available on our menu or website.
• Please provide a full delivery address and a suitable drop-off location (e.g. front door, terrace, hotel reception).
3. Delivery
• Delivery times: On working days between 5:00 a.m. and 9:00 a.m. or during our official business hours.
• We deliver within a 20 km radius around Vélez-Málaga.
• A delivery fee applies but is waived for orders above a certain value (see website for details).
• Delivery is made personally or contactless – depending on customer preference.
• A photo of the delivery is taken and sent via WhatsApp as proof.
4. Payment
• Payment must be made in advance (e.g. PayPal, credit card) or in cash upon delivery.
• The order is only valid once payment has been received or cash payment agreed.
5. Cancellation & Right of Withdrawal
• As we deliver perishable goods, the right of withdrawal is excluded under Article 103 of the Spanish Consumer Law.
• Cancellations are not possible after payment.
6. Complaints
We place great importance on quality.
• Please check your delivery immediately upon receipt for completeness and defects.
• If there is anything wrong, notify us immediately so we can find a solution.
• Later complaints regarding perishable goods can unfortunately only be accepted to a limited extent.
7. Data Protection
• Your data (name, phone number, address, delivery location) will be used exclusively for order processing.
• No data will be passed on to third parties – no advertising.
• A complete privacy policy is available upon request.
8. Legal
• Spanish law exclusively applies.
• Place of jurisdiction: Vélez-Málaga (Spain).
9. Business Customers (B2B)
• The same terms apply to business customers.
• An invoice including NIF will be issued upon request.

1. Ámbito de aplicación
Estas condiciones generales se aplican a todos los pedidos realizados por clientes privados o comerciales por teléfono o por medios electrónicos (WhatsApp, SMS o correo electrónico).
2. Pedidos
• Los pedidos deben realizarse por escrito a través de WhatsApp (formulario o mensaje libre).
• Plazo de pedido: antes de las 18:00 h del día anterior a la entrega.
• La gama de productos y los importes mínimos de pedido se encuentran en nuestra carta o página web.
• Indique una dirección de entrega completa y un lugar de entrega adecuado (p. ej. puerta de entrada, terraza, recepción del hotel).
3. Entrega
• Horario de entrega: días laborables entre las 05:00 y las 09:00 h o durante nuestro horario comercial.
• Entregamos dentro de un radio de 20 km desde Vélez-Málaga.
• Se aplica una tarifa de entrega, que se exime a partir de un importe mínimo (ver detalles en la web).
• La entrega se realiza de forma personal o sin contacto – según la preferencia del cliente.
• Se toma una foto de la entrega y se envía por WhatsApp como comprobante.
4. Pago
• El pago debe realizarse por adelantado (PayPal, tarjeta) o en efectivo a la entrega.
• El pedido solo será válido tras recibir el pago o acordar el pago en efectivo.
5. Cancelación y derecho de desistimiento
• Dado que entregamos productos perecederos, no se aplica el derecho de desistimiento conforme al artículo 103 de la Ley de Defensa del Consumidor en España.
• No se pueden cancelar los pedidos una vez realizado el pago.
6. Reclamaciones
La calidad es nuestra máxima prioridad.
• Por favor, revise el pedido inmediatamente al recibirlo para comprobar su integridad y posibles defectos.
• En caso de irregularidades, infórmenos de inmediato para poder encontrar una solución.
• Las reclamaciones posteriores con productos frescos solo se pueden aceptar de forma limitada.
7. Protección de datos
• Sus datos (nombre, teléfono, dirección, punto de entrega) se utilizan exclusivamente para la entrega del pedido.
• No se comparten con terceros – no se hace publicidad.
• Podemos enviarle una política de privacidad completa si la solicita.
8. Legalidad
• Se aplica exclusivamente el derecho español.
• El fuero legal es Vélez-Málaga (España).
9. Clientes comerciales (B2B)
• Se aplican las mismas condiciones.
• Emitimos una factura con NIF si así lo desea.
